Sofia Yang Art - Commission Terms of Service

By commissioning artwork from Sofia Yang Art, the client confirms that they have read, understood, and agreed to these Terms of Service. Submission of any deposit, installment, or full payment through Stripe constitutes acceptance of these terms.

1. Pricing & Complexity Fees

Commission prices are based on the scope of the requested artwork, including size, number of subjects, background, materials, level of detail, and estimated labor.

All listed or quoted prices are subject to additional complexity fees. Complexity fees may apply to detailed backgrounds, architecture, multiple figures, intricate clothing, complex lighting, extensive environmental elements, or other labor-intensive requests.

Any applicable complexity fees will be communicated before the commission is accepted whenever reasonably possible.

2. Payment

All payments are processed through Stripe using an official invoice or payment link provided by Sofia Yang Art.

The payment structure is:

  • Commissions under $500: 100% upfront.

  • Commissions from $500–$999: 60% upfront and 40% before final shipment or digital delivery.

  • Commissions of $1,000 or more: 50% upfront, 25% after sketch approval, and the final 25% before shipment or digital delivery.

Sofia Yang Art may require a higher initial payment or full upfront payment for unusually large, rush, highly customized, or higher-risk commissions.

Work will not begin until the required payment has successfully cleared through Stripe.

A screenshot, email, bank notification, or message claiming payment was sent does not constitute proof of payment.

Final physical artwork will not be shipped, and final high-resolution or unwatermarked digital files will not be delivered, until the full balance has been received.

Commission slots are not held without payment.

By paying a Stripe invoice or payment link, the client acknowledges and agrees to these Terms of Service.

3. Payment Security & Fraud Prevention

Sofia Yang Art reserves the right to verify client, billing, payment, and shipping information before beginning or continuing a commission.

Clients may be asked to provide reasonable information necessary to confirm the legitimacy of a transaction.

Sofia Yang Art does not accept:

  • Personal or business checks;

  • Cashier’s checks;

  • Overpayments;

  • Requests to forward excess funds to another person or business;

  • Requests to pay third-party couriers, assistants, vendors, relatives, or other parties on the client’s behalf;

  • Payments made through unapproved methods.

If suspicious, inconsistent, or potentially fraudulent payment activity occurs, Sofia Yang Art may pause or cancel the commission.

Any legitimate refund will be returned through the original payment method whenever reasonably possible.

4. Refunds & Cancellations

Commission payments are generally non-refundable once work has begun.

The initial payment compensates Sofia Yang Art for reserving commission availability, consultation, planning, preparation, materials, sketching, and work performed.

A full or partial refund may be offered at the artist’s discretion if:

  • Work has not yet begun;

  • The artist is unable to complete the commission;

  • The artist is unable to reasonably meet an agreed-upon deadline; or

  • The artist determines that the project or client relationship is no longer workable.

Any discretionary refund may be reduced to account for work already completed, materials purchased, and payment-processing costs already incurred where permitted by applicable law and Stripe’s policies.

Refunds are not automatically available because the client changes their mind or decides not to continue after work has begun.

Nothing in this section prevents a client from exercising legitimate rights available under applicable law or through their card issuer.

5. Revision Policy

Each commission includes two designated revision periods.

Revision Period 1 — Sketch Approval

The first revision period occurs after the initial sketch is presented.

This is the client’s opportunity to request major adjustments to:

  • Composition

  • Pose or positioning

  • Facial features

  • Clothing

  • Objects

  • Background layout

  • Major proportions or placement

Up to two reasonable edits are included during this revision period.

Once the sketch is approved, the composition and major structural elements are considered finalized.

For commissions of $1,000 or more, the second scheduled payment is due after sketch approval and before substantial painting or coloring continues.

Revision Period 2 — Final Review

The second revision period occurs when the artwork is nearly complete.

This stage is intended only for minor final adjustments, including small color corrections, subtle details, or minor refinements.

Major changes to composition, pose, subjects, clothing, facial structure, background, or other previously approved elements are not included at this stage.

Additional revisions or major changes requested outside these two revision periods may be refused or charged an additional fee.

6. Reference Materials & Client Responsibility

Clients are responsible for providing clear, accurate reference photographs, descriptions, and relevant details before work begins.

The quality and accuracy of the finished artwork may depend on the quality of the references provided.

The client represents that they have the right or necessary permission to provide any photographs, images, or other materials submitted as references.

The client is responsible for communicating any details that must be depicted accurately before sketch approval.

New references, conflicting instructions, or major information provided after sketch approval may be treated as additional revisions and may require an additional fee.

7. Communication & Response Time

Both the artist and client should make reasonable efforts to respond to commission-related communication within one week.

If Sofia Yang Art is waiting for necessary feedback, approval, references, payment, or other information, one follow-up message may be sent.

If no response is received within 5 days after that follow-up, work may be paused until communication resumes.

Once the client responds, the original completion date is no longer guaranteed. A revised deadline must be discussed based on the artist’s current schedule.

Sofia Yang Art is not responsible for delays caused by late client responses, delayed approvals, missing references, or unpaid balances.

8. Deadlines

Estimated completion dates are estimates unless a specific deadline has been agreed to in writing.

Clients must disclose required delivery dates, including birthdays, anniversaries, weddings, holidays, or other events, before payment.

Completion timelines may be affected by revisions, drying time, material availability, shipping delays, emergencies, client response times, payment delays, or other circumstances reasonably outside the artist’s control.

Rush deadlines may be subject to an additional fee and must be approved before payment.

9. Artistic Interpretation

Commissioning Sofia Yang Art means commissioning artwork in the artist’s existing style.

The artist retains reasonable creative discretion over brushwork, color, lighting, composition, texture, and artistic interpretation.

Minor differences between reference photographs and the finished artwork are part of the artistic process and are not considered defects.

10. Copyright & Ownership

Unless otherwise agreed to in writing, Sofia Yang Art retains all copyright and intellectual property rights to commissioned artwork.

For physical commissions, the client owns the physical artwork after full payment has been received.

Ownership of the physical artwork does not transfer:

  • Copyright;

  • Reproduction rights;

  • Commercial rights;

  • Licensing rights;

  • Digital distribution rights; or

  • Intellectual property ownership.

For digital commissions, the client receives the finished digital artwork for the agreed personal use but does not acquire copyright or intellectual property rights.

11. Artist Portfolio & Promotional Rights

Unless otherwise agreed upon before the commission begins, Sofia Yang Art retains the right to photograph, reproduce, publish, and display commissioned artwork for professional purposes, including:

  • Artist portfolios;

  • Website;

  • Social media;

  • Future commission examples;

  • Promotional materials;

  • Exhibitions;

  • Applications;

  • Printed or digital artist materials.

Clients requesting a private or confidential commission must discuss this before payment.

12. Prohibited Uses

Without prior written permission from Sofia Yang Art, commissioned artwork may not be:

  • Used to train, develop, fine-tune, test, or contribute to artificial intelligence or machine-learning systems;

  • Uploaded to AI image generators for transformation, imitation, style replication, or derivative generation;

  • Minted, sold, promoted, or used as an NFT or blockchain-based asset;

  • Resold as prints, reproductions, merchandise, or other products;

  • Relicensed, sublicensed, or commercially distributed;

  • Used in advertising, branding, packaging, or other commercial materials;

  • Significantly altered, repainted, redrawn, digitally manipulated, or edited;

  • Repurposed into another artwork, design, product, logo, or commercial asset;

  • Presented as the work of another artist.

Any commercial use or licensing arrangement requires separate written permission and may require an additional licensing fee.

13. Alterations

Clients may not substantially alter, repaint, redraw, digitally modify, apply transformative filters to, or repurpose the finished artwork without the artist’s consent.

If an adjustment is desired after completion, the client should contact Sofia Yang Art first.

The artist may choose to make the requested change or provide written permission for an alteration.

Unauthorized alterations that materially misrepresent the artist’s work may result in refusal of future commissions.

14. Artist Credit

When commissioned artwork is shared publicly, displayed online, published, or otherwise presented where attribution is reasonably possible, the client must credit Sofia Yang Art as the artist.

The artist’s signature may not be intentionally removed, obscured, or replaced with another person’s attribution.

15. Shipping & Delivery

Shipping costs are the responsibility of the client unless otherwise stated.

The client is responsible for providing a complete and accurate shipping address.

Unless otherwise agreed in writing, physical artwork will be shipped only to the shipping address associated with the order or subsequently confirmed by the client in writing before shipment.

Physical artwork will be packaged with reasonable care.

Tracked shipping will be used for physical commissions whenever reasonably available.

Sofia Yang Art may require:

  • Shipping insurance;

  • Signature confirmation; and/or

  • Additional delivery safeguards

for higher-value commissions.

For commissions valued at $500 or more, signature confirmation may be required.

Once a package has been transferred to the shipping carrier, Sofia Yang Art is not responsible for carrier delays, customs delays, or circumstances outside the artist’s reasonable control.

The final required payment must be successfully received before the artwork is shipped.

16. Documentation & Approvals

Sofia Yang Art may retain records related to the commission, including:

  • Client instructions;

  • Reference images;

  • Stripe payment records;

  • Sketch approvals;

  • Revision requests;

  • Progress images;

  • Written approvals;

  • Final review communications;

  • Shipping and tracking information; and

  • Delivery confirmation.

Written approval of a sketch, revision, or final review confirms that the client accepts that stage of the artwork.

Clients are encouraged to communicate approvals and revision requests in writing so that both parties have a clear record of the commission process.

17. Payment Disputes & Chargebacks

Clients are encouraged to contact Sofia Yang Art directly regarding legitimate concerns before initiating a payment dispute.

A payment dispute or chargeback does not automatically transfer copyright, licensing rights, or additional usage rights to the client.

Sofia Yang Art reserves the right to provide Stripe, card issuers, financial institutions, or other relevant parties with documentation necessary to respond to a dispute, including:

  • These Terms of Service;

  • Stripe invoices and payment records;

  • Commission descriptions;

  • Client correspondence;

  • Reference materials;

  • Sketch and revision approvals;

  • Progress images;

  • Final approval;

  • Shipping information;

  • Tracking records; and

  • Delivery confirmation.

Knowingly false or fraudulent payment disputes may result in termination of the commission and refusal of future services.

Nothing in these Terms is intended to prevent the client from exercising legitimate dispute rights available under applicable law or card-network rules.

18. Right to Decline or Terminate a Commission

Sofia Yang Art reserves the right to decline any commission before accepting payment.

The artist may also discontinue an active commission in cases involving:

  • Harassment or abusive communication;

  • Repeated unreasonable demands;

  • Persistent violation of these Terms;

  • Suspected payment fraud;

  • Requests involving prohibited uses;

  • Repeated failure to communicate;

  • Inappropriate requests; or

  • Conduct that makes continuing the project uncomfortable or unworkable.

If the artist terminates a commission, any applicable refund will be determined based on work already completed and expenses incurred.

19. Governing Law & Severability

These Terms are governed by the laws applicable to Sofia Yang Art’s principal place of business, without regard to conflict-of-law principles.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

20. Agreement

By submitting a deposit, installment, or full payment through Stripe, the client acknowledges that they have reviewed, understood, and accepted these Commission Terms of Service.
